Recent car accident may have stemmed from drowsy driving

A woman from another state has suffered serious injuries in a single-car crash in Texas. The car accident took place on a recent Sunday night in an intersection. Motor vehicle accidents are usually due to driver negligence and often result in claims for monetary damages filed through the state’s civil justice system.

The Texas crash took place in Lufkin at about 11:30 p.m. According to police, a man driving a sport utility vehicle fell asleep behind the wheel.  The vehicle then left the roadway and struck a traffic device and light pole.

A female passenger struck her head as a result of the impact of the crash. She was transported to a medical center for treatment. The driver was fortunate to escape serious injury in the accident. Authorities continue to investigate the cause of the collision.

The injured passenger would appear to have grounds to file a personal injury claim in a Texas civil court against the man who was driving the car in which she was injured, seeking monetary damages. If she can prove he was negligent — and drowsy driving would likely qualify — and that the driver’s negligence was the proximate cause of the collision, a court may award her a monetary judgment for documented financial damages. Any monies recovered by a successful civil claim could be used to help to cover her hospital bills resulting from the car accident. Likewise, damages may help to reimburse her for any pain and suffering as well as emotional distress resulting from the tragedy.
