Motor vehicle accident results in 1 death, DUI charge

A woman’s life has sadly been snuffed out in a motorcycle collision in Texas. Now, the woman’s family members are left to question how their loved one could have been taken from them so soon, and to grieve over her death. Another woman who reportedly caused the multi-vehicle accident due to driving under the influence was taken into custody following the accident.

The motorcycle accident took place at about 11:15 p.m. on a recent Sunday night. According to authorities, a 39-year-old woman was driving a pickup truck south along Interstate 35. She reportedly struck an impact attenuator on an off-ramp. Her vehicle then hit a motorcyclist who was in the interstate’s center lane.

The 33-year-old woman who was operating the motorcycle passed away at the crash scene. The woman who allegedly caused the accident now faces a charge of intoxication manslaughter as a result. Authorities continued to investigate the motor vehicle crash.

The loved ones of the motorcyclist who died in the accident may choose to file a wrongful death claim against the pickup truck driver in a Texas civil court, seeking the reimbursement of documented monetary damages. If the truck driver ends up being convicted on the intoxication manslaughter charge, proof of this conviction may be presented in a related civil court proceeding to establish negligence per se regarding the fatal motorcycle accident. If the motorcyclist’s loved ones are successful in their claim, they may be awarded financial damages to cover the deceased motorcyclist’s funeral expenses and other losses resulting from the accident.
